Personally I question why we should be bound by the Geneva Convention when the enemy isn't ? If we were fighting say the French who have signed it then fair enough but the Taliban haven't so they shouldn't be protected by it.

The only caveat I might apply to this response is that we have to be very careful not to legitimise activities that contravene the Geneva convention, and that applies even more when on foreign soil in my view. Still, in this case he was proven to have mental health issues, so maybe that is that. But why was he still in the battle field?
