This is the official response from the Insider

We have already made two statements about the flags to this affect around the last two EDL marches in Brighton - which were attended by a handful of people) - we are aware of this and are working closely with the Police. We have confiscated these (flags) at Withdean. Once the new logo is adopted it will be fully copyrighted and therefore we (or police) will be able to seize these. As you can imagine though, those type of marches are powder kegs, and such actions might cause more trouble. So it's about managing the situation.
