Something of interest that I picked up today from an interview that they did with someone sipping champagne in Falmer.

The interviewee said "John Prescott didn't give a yes to Falmer, as he knew we would be able to ask for a judicial review".

Now, to me, this seems like good news. Perhaps this guy hasn't understood the full implications of his remarks. Bearing in mind what Lord Bracknell has said regarding the judicial review, John Prescott has ensured that if he is satisfied that there is no viable alternative to Falmer, then he will give us a yes and the NIMBY's can't then go for a Judicial Review.

WE WILL GET FALMER.

I think they would still be able to ask for a Judicial Review, and the Falmer Nimbys undoubtedly would, they want to burn all that money they've collected, that much is certain.

The question is whether they would be granted leave to be given one by a judge, and, if they were, whether another group of judges would be prepared to overturn the whole process.

Never underestimate the idoicy of British judges, remember they come from that very narrow strata of British society that has Countryside Alliance/"saving rural life" written all over them.

But at least Prescott is giving us the best chance possible when this process does reach the judges. This new process of testing the alternative sites will leave less and less room for manoeuvre for wacky legal get-outs.

But surely they need grounds for a judicial review. They would need a legal reason for asking for one.

If he has ignored the inspectors reports out-of-hand, then they would have grounds.

If he asks for clarification on the reports presented to him on the alternative sites, and these are proved to be inferior to Falmer, then this removes their main argument for requesting a judicail review.

Perhaps I'm just too :dunce:

did you catch the interview with the leader of falmer parish council when he said
"some of the ladies" he then quickly corrected himself "couples have been having sleepless nights waiting for the decision"
does he think we are going to decend on falmer if we get the ground on an orgy of rape and pilage.

Which makes it unlikely they will put forward many convincing arguments for the alternative sites.....in fact, who the hell will be arguing the case FOR Sheepcote Valley, Toads Hall, etc? The Falmer NIMBYS are only interested in saying No to Falmer, I can't imagine they will be well versed in the so-called positive aspects of Sheepcote et al.....

I think that's exactly what Prezza has done! He has a number of areas of conflicts with Hoile/Collyer and the Nimbys could challenge every one if they so desired. I wonder if a lot of Prezza's decisions on this are even precedents. It all depends on the mentality of the judge who gets the application for a judicial review.

I'm very optimistic that we will win this second stage of the planning inquiry, but I am not convinced because of the extraordinary nature of this application that there won't be some room for judges to stick their oars in.
