This thread reminds me of a builder's van I saw down by Corfe Castle in Dorset, which had the following sticker on the back: "No Jaffa Cakes left in this vehicle overnight" which made me chuckle.

Mrs Orange used to work for United Biscuits and has been to the Jaffa Cake line at the factory.

Definitely cake, it's in the name, and legally settled.

Cake. However, for those of us that have the "honour" of filling the cake aisle in a supermarket, they are biscuits. Doesn't stop regular smart arses asking why they are not in the cake aisle though.

Apparently that was the argument that won over the HMRC as they have different VAT rates but I have never verified that so it might be nonsense.

That said a tomato is a fruit but I wouldn't put it in a fruit salad.

Mr Donald Potter QC settled this in a court case back in 1991.

They are definitely a cake in the eyes of the law. It also meant Mcvities didn’t have to pay VAT, as apparently you don’t have to on cakes, whereas biscuits you do.

Biscuits are luxury items for tax purposes, whereas cake is just regular food... or something.
