Why do I get the feeling you're about to ask if a tree makes a noise when it falls down in the woods, if no one hears it? There is an amount of time the it takes the earth to go around the sun. And long before we had the language to describe it, we were aware of the changes in seasons that come about from rotating around the sun. So at some point, humans developed language, and had terms for seasons and years. At a later point, humans worked out how many days there were in a year. We didn't decide the number of days, we worked it out.

You're a bit confused. We could have divided days into a different number. We could have had 10 long hours if we wanted. But we couldn't have decided to have 360 days in a year.

Of course we could have, in exactly the same way as we could have decided to have 10 hours in a day - 'long' or otherwise.

Think of it as using metric or imperial measurements, the actual length is still the same whether we use either scale.
