Adavice on banning periods from the Amex

A friend of mine was recently arrested at the Palace game, a moment of stupidity and he’s arrested.......I do not condone his action, neither does he and is prepared to accept the fallout of his actions.

However, if he receives a 2 month, 10 month, 14 month ban etc from our ground....what is the procedure for his seat allocation? I would imagine if his ST is on credit he pays up for the season, does that mean he can loan it to another friend, the seat stays unused or do the club have the right to sell on to another waiting customer? In the 1901 you can loan your seat out and it appears after speaking to the club the liability is with the supported attending no the licence holder.

No judgmental comments please guys, just views and where possible, actions on what the club can and cannot take. I am fully aware he may well get a life ban and a 7 year banning order from football grounds. Thanks.

The club reserves the right to withdraw and cancel the Seasons Ticket Smartcard in the event that the holder's behaviour is found to be in breach of the Ground Regulations at the Amex, or any other club.

What did the police do? What was he charged with? If it was a caution or something, would the club still be informed?

Nicked, charged, bailed and court date.....pretty nailed on. Whether it is deemed to be football related is a matter for the police and club i would imagine.

What does the Ground Regs state about away fans in the home ends? It a very grey area for me regarding the 1901 sections.

It all boils down to what he is charged with when considering how long he will be out of the game for.* Even if it was a caution I would expect the club to be in touch and probably issue a club ban, which can usually be appealed if you set up a meeting with the Nazi's and sign a bit of paper to promise to be a good boy.*

I'd say if he's convicted of a Section 5 offence he might get away with a slap on the wrists (£80 fine and a year ban from Falmer).* Section 4 – heavy fine + 3 year banning order (worse if have previous convictions).* Anything worse than Section 4 theres a fair chance of a custodial sentence plus 7 year banning order.* Hope this helps.

Don't take my word as proffessional advice though! The person who will best be able to let him know the likely outcome is his solicitor (if he hasn't got one yet - get one) who will have all of the facts to hand. If I was in his shoes I would be going all out to convince the judge/magistrates how sorry I am and how genuinely out of character the incident was. If he does get the dreaded FBO just make sure he knows to be on his best behaviour, then he can appeal after 2 thirds of it to have it rescinded. Best of luck to him.

Surely a Football Banning Order doesn't apply to the crap they serve up for 90 minutes a fortnight at Selhurst? Isn't it the only ground in the country that's exempt? He could just apply for a season ticket there while he waits to return to the Amex to see the beautiful game.

The seat will be withdrawn and offered to a holder on the waiting list. I can't see him being allowed to keep it, especially if ejected from the ground.

You seem particularly interested in the 1901 rules and regs. He wasn't a 1901'er was he?

I understand if you want to keep him under wraps!

No certainly not a 1901 member, many of are general Albion group are though. Hes been to many many away games over the years as well, I cant help but think that for something so small he misses so much.

If it happened outside the ground what will a banning order really do (not saying to your friend) but if you are going to have a fight/ general violence it won't stop you from turning up so in my opinion I think banning orders are pointless.

Most banning orders these days have radius restrictions as well mate. Usually town centre and around the stadium for home games and flat 10 miles for away games. Let's face it these places are the most popular arenas of combat so anyone placed on an FBO would have to put in a hefty amount of effort to get a row without breaching.
