If he doesn't resign, under laws introduced in 2015, any prison term, even a suspended sentence, leads to a recall petition. This is open for six weeks and can force a byelection if signed by 10% of voters in a constituency. The petition can only start once any appeals against the sentence have been dealt with.

I'm sure I've also read somewhere that if a prison sentence of 12 months or more is passed down - then it's bye bye MP.

You would hope he would have resigned by now and it doesn't come to that.
I don’t think “doing the right thing” is high on his personality traits given what we’ve seen to this point

There are 71,955 registered voters in the constituency, so 10% needed for a recall. It is possible if Reform and/or the Conservatives gets all it's voters out, but unlikely.

Party politics don’t necessarily come into it. Lying criminals Onasanya and Ferrier were both removed from the Commons by the petition route in the last 5 years, it just takes a momentum to build of people doing the right thing. In the internet age support for a petition can easily build.

Now the question is his sentence.

It’s a summary only offence, and he’s pled guilty to the single charge of Section 39 common assault (aka assault by beating).

There appears to be no aggravating factors (wounding, racial or religious aggravation or assault on an emergency worker), if he’s sentenced under Category A he’s looking at anything from a Community Order to up to 6 months prison with fine.

I think it’s realistic to say he’ll be looking at the lower end, as while cowardly and disgusting, it was likely a first offence, he’s shown remorse and the offence doesn’t score highly on the sentencing charts.

My guess would be circa: 180-240 community service hours, anger management and alcohol awareness courses, a fine, costs and a small amount of compensation.

Probably not enough to trigger a by-election, although his suspension from Labour has now become eviction from the party.

I tend to agree.

Going from the BBC report I would say its High Culpability due to "Prolonged/persistent assault" (hits the bloke when he's on the ground).
There's nothing about any injuries so assume its category 2.
Starting point is Medium Level Community Order and the range is Low level community order – 16 weeks’ custody.
Given that he's of previously good character and has pleaded guilty at the first opportunity I think they are ruling out a custodial sentence (there's no mention of an "all options" report on the BBC or Sky).

Well Huw Edwards walked out of Court after being convicted of being a nonce so not sure you can bang this fella up for lamping a bloke in the street and causing no serious industry.

He should be kicked out of Parliament though.

Well if he doesn't end up in prison I'm sure everyone will accept the decision and move on and not try and sensationalise things or make spurious comparisons to rioters or anything

Was he remanded ? I thought he was on bail. IME it's very unusual to remand for (first offence) assault, you normally only withhold bail if he's likely to do a runner, commit further offences or if custody is very likely.

He wasn’t remanded, for the reasons you state.
