Right lets say the judge quashes the decision, it is sent back to Prescott who looks at it again and sticks by his decision to grant permission, is he able to do that even though the judge has quashed it in court?.
please excuse my ignorance with the law my only dealings with judges are unpaid parking fines and not paying my tax.

The 'quashing' will be that the approval will be effectively nullified. The judge will order the ODPM to re-consider the case but taking into account 'X, Y and Z' factors. He will only do so only if he deems one, some or all of Lewes' challenge on these points are relevant and valid.

The vast majority of Prescott's new letter will be the same - Lewes only seem to be challenging on technicalities, not real material considerations. The only things which will change are the things he has been told to re-consider. We are extremely confident that none of any reconsiderations there will be enough to turn the application down.

The short answer is that they object to anything they do not like in an AONB. Their failure rate is 40% over all their objections.

More serious criticisms I think was their qualative decision to support Sheepcote Valley, suggesting removing an area of public open land with environmental qualities over an area of private farmland.
