Not true you can say what you like on a reference good or bad provided you can back it up or stand the risk of being sued.

If you can irrefutably prove a person stole from you it is permissible to say you sacked the person for stealing but if you can't prove it god help you.

As regards the dilemna that you are in better the second because as the saying goes 'be good to those on your way up because you may see them on your way down'.

In big companies it's pretty standard to have an "exit interview". I did in the last job that I left but-one, in which I told the MD of the company that the bloke who was supposed to be two levels of management above me had not spoken to me in the nine months I worked there... despite the fact I sat at a desk about twenty feet away. In the same room and everything.

If you have one of these (and you could ask for one), find a way of subtly dropping your boss in the shit with his superior.

But only subtly.
