What would happened if the lib dems were not in overall control of the council after the elections ref an appeal against the yes vote for Falmer.

The Lib Dems are not in overall control of the council now. They share cabinet places with the Tories. The cabinet would have to make a decision on whether to proceed with a judicial review. Any Seagulls Party members would be able to call the decision to full council, for a TRIED and TESTED, PUBLIC decision to be made.
Hopefully some of those Lib Dem councillors on LDC who are currently campaigning on the doorsteps by telling stadium supporters that they don't agree with the party leadership will have the bottle to carry that through into the Council chamber.
Assuming they get elected, of course. Maybe the voters will turf them out once they get wind of the nauseating opportunism and sheer bloody cowardice that lies behind what they are now proclaiming.
