Im guessing by where the photo was taken from it was on the pitch. If the police wanted the identites of the person(s) with flares they could have got them from this photographer/the tv cameras who picked out one individual with a flare.

The fact that fella behind looks mighty scared is part of the reason why the things shouldn't be bought into a football ground. I don't what the bloke with the flare banned, but he should take note that not everyone shares his enthusiasm for it, and he should not bring one again.
