Just to clarify a few bits about Mr Catt.

He moved to the stadium after we did.
In an article by the Argus on his peace campaigning he said he was deaf!
There have been numerous sound surveys carried out by the council all of which have concluded that there is no nuisance.
He is being funded by legal aid in this action.

Yes you do have a right to object. But you also need to be reasonable.

If he didn't want to be surrounded by fairy queens, then he picked the wrong city! ;)

i bet he's the gut that used to put his garden chair at the end of his garden and watch the game. Sadly when they built the new stand he couldent see.

You shouldn't have to, but if he finds the noise unbearable then he should visit friends or family during matchdays. It doesn't hurt to give and take a little. BHAFC who do alot for the community have to put up with village facilities, why can't Catt just let it rest?

Is that really true? I thought he'd been a long-time resident.

If it is true, his chances of winning have gone from slim to none.

I think he moved there when we were playing there, but he is complaining about the new stand really, that has increase congestion and noise etc.

A poster here used to live in that road and can confirm. Can't remember the name though.




Is this just a case of waiting for the club to confirm what has happened or will there be a press release somewhere on the net as soon as it happens??

The bastard lost on all counts, the judge even said he was out of time to appeal - how the f**k could he get legal aid to support this, what a joke the legal system is! Because he's on legal aid we don't get any costs awarded, so much for f**king justice!!!!

Albion Win Withdean Court Battle

The Seagulls have won their case brought by John Catt, a Withdean resident, who challenged the planning application for the additional seats at Withdean.

Mr Justice Collins, who handed down his judgment in the High Court this morning, dismissed all the grounds for challenge by Mr Catt; that the club should have submitted an Environmental Impact Assessment (EIA) with the planning application for the new seats and that the decision was made unlawfully by Brighton & Hove City Council.

Mr Collins found that the council had considered all the issues relating to the need for an EIA and had concluded correctly that it was not needed.

He also found that all the issues had been considered correctly by the planning committee and that the decision was lawful.

Finally, he found that Mr Catt had not kept the Albion or the council properly informed as to his intention to challenge the decision and that he was out of time in lodging his challenge.

In addition, Mr Collins dismissed an application by Mr Catt to appeal against his judgment.

Albion chief executive Martin Perry said, "This challenge should never have been brought. Brighton & Hove Council got their decisions spot on this time and have handled it very well.

"It is an outrageous use of public money by Mr Catt. He used Legal Aid to bring this unnecessary action and he has forced the council and the club into spending thousands of pounds both defending it and answering spurious questions under the Freedom of Information Act.

"We have no chance in this case of recovering our costs because he is being supported by Legal Aid.

"However let this be a salutary lesson for Lewes District Council. Spurious challenges in the High Court can be defeated and we have put Lewes on notice that if the judgment by the court is similar to the terms of the Consent Order offered to them by the Treasury Solicitor, we will seek to recover our costs of the court action.

"The costs to Lewes could run to hundreds of thousands of pounds. Our costs alone are likely to be in the order of £75,000 and you have to add to that the costs incurred by the Treasury Solicitor, Brighton & Hove City Council, and their own.

"We repeat that it is totally unnecessary for the challenge on the Falmer decision to go to court and Lewes District Council are gambling with thousands of pounds of tax-payers' money."
