I think you need to get some perspective. A few hundred quid to sort out the tree roots is peanuts compared to the profits from building and selling a house on the site.

Thanks very much for this. We think it very “unusual” too that they can just go ahead with the work without saying anything to us about it first and then make us pay...

What would be your advice about how to proceed?

Ask them those questions. And if they start talking about 'excavations' ask them to tell you what excavations you've carried out. There may be some obscure part of the legislation that they're relying on, but at least make them tell you what it is!
