Even as a publican I said it should be zero. It is the only offence that you can commit without knowing it as nobody knows exactly how much they can drink and be legal so if it was zero they would know 1 drink and they are over the top .

I think it is now 35 milligrams per 100 or similar but in true terms it represents 1 drink up to 3 drinks depending on many factors.

to account for alcohol in medicinal products, foods and those that metabolise alcohol slowly. a zero limit would effectively outlaw driving 12 hours or so after having a glass of wine. the limit is fairly arbitary and the reasons for no zero limit also suggest it shouldnt be fixed but used as as guidline. i believe this is the underlying intent.

If I have 100 mg in my breath, 80 in my blood and then 107 in my urine that would be 287 mg.
I`d be well pissed.

I fully accept your reasoning but why is that some countries eg Sweden can have a zero limit. Could they not, with modern technology, set a limit that allows for cooking etc but is insufficient to allow somebody to consume an alcoholic drink.

I got pulled over the other Saturday at about 1pm for not having my seat belt on. I'd had quite a heavy Friday night and just had two pints of Guinness. The copper told me he couldn't do the breath test as I'd only just come from the pub and by law he had to give me 20 minutes. We hung about for a bit and he said lets do one now and if you fail you can take another one in 20 mins. Anyway I blew and past no problems much to both of our surprise if I'm being honest.

Cheeky bastard then proceeded to tell me that he's known larger chaps such as myself to have 6 or 7 pints and still pass it. So I would say it all depends on your size and how much you can and what you drink. I certainly wouldn't fancy my chances passing after 6 or 7.

I would say it all depends on your size and how much you can and what you drink. .

In my past I have passed 3 breatherlysers that I should never have done but have now seen the light and havent had a drink and driven for some 15 years but like many I would be a possible the day after a session.

Not only that, but it's nothing to do with your own perception of how you can handle your drink. I get guys telling me before being breathalysed they're OK because they can drink 8 pints without falling over no problem, but that itself is no guide to what your body has in its system: it simply tells that you're more used to drinking lots. You'll still more than likely be well over the limit: the alcohol doesn't go away simply because you're not displaying all the symptoms of being pissed.

I wouldn't fancy my chances after two Guinesses (or even half a Guiness). Best idea is don't drink and drive at all.

Absolutely.

I've known someone fail a roadside test despite looking perfectly sober, then stroll into the Custody centre and blow one of the highest readings I've ever seen on the evidential machine. If I had that much alcohol in my body, I'd probably be dead.

Think she was an alcoholic, therefore her body, despite being well over the limit, was used to large quantities of alcohol and showed fewer outward signs of being drunk.

Even if you think you're normally OK by drinking a certain amount, circumstances on an individual occasion may mean you fail- type of drink consumed, medication, food, illness, whatever. If you're over, you're over, it's pretty much a cut & dried thing, and the court won't acquit on the basis that you didn't eat dinner that night.

Again I'd say it's all down to the individual. A friend of mine had a reasonably heavy Saturday night (2am finish kinda thing), drove his mum to Luton airport teh next morning. He got pulled over for speeding on the way back at about 1pm on the Sunday and failed a test. He contested it so them took him in for a blood test which by the time they'd got everything sorted was roughly around 2:30 and he still failed.

So basically if you do think you might be risking it, don't be a dick like me and not put your seat belt on and don't be a dick like my mate and speed!
