Suing a Company

This morning, I went into the toilet where I work and almost fell arse over tit. Luckily I managed to just about stay on my feet. This was due to the fact that the cleaner had just washed the floor. I was quite peeved as I saw no signs saying slippery surface etc. This is a regular occurrence where I work. Some days when I go in I occassionally have a coffee in hand which I put on the window seal whilst I relieve myself.

My question is, say for example I walked in and scalded my hand and slipped because of the negligence of the cleaner, am I able to sue the people that we rent our office space from i.e. the owners of the building?

I very much doubt it, unless they manage the building. If your company is responsible for the running of the office and facilities, then it is their responsiblity to make sure health and safety guidelines are adhered to.

If this is a regular occurrance, you think that it might have twigged to take a bit more care in future!

as far as I am away the people who clean the toilets are employed by the owners of the building, who we in turn rent out our office space from.

I do think it is quite strange, but where I used to work they were pretty strict about putting signs up in case of people injuring themselves.

Probably best to contact them, rather than think about getting a bit of cash from a staged accident. You never know, someone might break their back in the meantime, whilst you are plotting your windfall.

NB Not suggesting that you would do such a thing. :D

a ludicrous suggestion like that hasn't even occurred to me.

The law will protect someone who is unaware of this probelm of wet floors. You however have encountered the problem before and have not acted to resolve it therefore in law you are also to blame. The health and safety act is based around "acts and omissions". Having seen the act you have omitted to do something about it. You need to highlight your concerns through the right channels and quickly.

Suing a company is a long and stressful ordeal. If you are not injured then forget about it.

The best thing to do would be to write to the Managing Director of the cleaning company, you will get more satisfaction this way.

If they continue to clean the floors without putting out any signs out then they are breaking the Health & Safety at work act and you could report them for this.

You've seen the mistake, and haven't acted on it. Therefore you have not taken dutiful care of yourself or those around you, therefore you too have breached the Health and Saefty Act. You naughty boy!!

As adrian29 said, contact their MD and get the little cleaner fired for being rubbish.
