If the rumours are true and Gordon Brown replaces Ruth Kelly in the ODPM office, what does that mean for the Falmer decision? Could LDC appeal on the grounds that the due process of deliberation was not able to happen as Kelly left office? If the decision is made by the new person in charge (whoever it may be) then won't they ask for a delay so they can come to an informed decision? Or maybe they'll ask for a Public Inquiry? :)jester:)

Neither Ruth Kelly nor Gordon Brown are in the ODPM. The ODPM does not have the planning portfolio, so will not be making the decision.

However, if Ruth Kelly is replaced as Minister for Local Government & the Communities, it will be her successor who makes the decision, almost certainly without any further delays.

ODPM no longer exists, planning now within the remit of the department for communities and local govt. The people who make the decision (i.e. the civil servants) wont change...

Yes, they'll probably challenge a YES decision, but I don't know where you got 60 days from. Previous challenges have had to be in within 35 days. It's then for the Seagulls Party to lead the hypocrisy charge against the Lewes Lib Dems when they do challenge, and hopefully, we can all be there right behind them.

Ruth Kelly may change, but the civil servants who will be offering advice wont change.

Therefore I would expect the incoming Secretary of State (if there is one) to follow the advice of the existing civil servants.

I shouldn't imagine there to be any delay. Still expect a positive decision on 9th July.

Obviously LDC will appeal - that's for sure, but it won't be on the grounds that the Minister for planning has changed.

If that is their only grounds for an appeal then we'll have very, very little to worry about :drink:
 




It is more than likely that Ruth Kelly will not continue in her present post when Brown takes over. Her only ally in the government is Blair (they are very close, that Blair will become a catholic once he stops being PM) and as she survives on his patronage and his alone, it seems fanciful that Brown will keep her on.

No guarantee that the Department will survive (unlikely but where are the Department for Social Security, DETR, DTLR, DPEI, DCA, ODPM, Department for Education and employment, MAFF, DSS, Dept for National Heritage) all of which have come and gone in the past 12 years.

and whatever FolkstoneSeagull thinks, it WILL be the politician who makes the decision. The civil servants can only reccomend a decision. If the minister doesn't agree with their reccomendation or options, it doesn't happen.


According to the Guardian..........it will actually be Dawn Primarolo
who makes the decision.

Normally, anyone who wants to challenge a Secretary of State's decision has 6 weeks from the date of the decision letter.

sorry to disappoint but word on the street here in the dti is that we're safe, as our present SoS becomes Gordon's Chancellor......
 


There was a rumour a few weeks back that Yvette Cooper might replace Ruth Kelly as the Secretary of State with planning responsibilities. Ms Cooper has been a junior planning minister for some time and is familiar with the Falmer application. No-one could accuse her of being 'new to the issue'.

The myth that these matters are dealt with at secretary of state level is exactly that ... a myth.

Au contraire ... the LDC Tories understand how significant was The Seagulls Party's decision not to put candidates up in Seaford and Telscombe Cliffs.

They owe us a favour.

More to the point, Pepper and Neighbour won't get a hearing this time round. And Neighbour won't be able to lean on the South Downs Joint Committee to push LDC into a further appeal.

:lolol: you've never worked in Govt I assume.

If there's a new SoS it will DEFINITELY hold things up. Maybe not by months but certainly for weeks.
