No doubt NSC's resident bleeding hearts will be on their soapboxes applauding this cretinous fool of a judge, but in my book the bloke shouldnt have been anywhere near a courtroom, if you break into someones house you should face whatever the HOUSEHOLDER deems necessary, if that is to bash the granny out of you whilst you're trying to escape, tough shit.

I tend to agree, but it's not the judge's fault. The law states REASONABLE force can be used. Battering them on the way out is not reasonable force so the charge is correct.

I don't agree with it and it needs to change. Hopefully this will trigger something.

You have the right to defend your property. But chasing the guy down and beating him to a pulp isn't defending your property it is dishing out your own form of "justice".

Let's be clear. It wasn't a case of the guy going over the top on an intruder while he was on his property (which I'd have sympathy for, and perhaps encourage a little). The intruder had left and was running away. Was no longer on the propperty, no longer an immediate threat.

Cahsing him down with your brother and weapons to beat him to a bloody skull cracked pulp isn't protecting your home.


Having said that, I have no sympathy for the burglar.

I agree with Bushy, the law is an arse. The intruder, who has lots of "previous" tied up his family, but broke free and hit the intruder with a cricket bat -GOOD ON HIM - the intruder gets a SUSPENDED SENTENCE, the defender gets jailed.

In my world, if you break into someone else's property - YOU GET WHAT IS COMING TO YOU - perhaps then, they will think twice about doing it.

This is what the judge said :-

"However, if persons were permitted to take the law into their own hands and inflict their own instant and violent punishment on an apprehended offender rather than letting justice take its course, then the rule of law and our system of criminal justice, which are the hallmarks of a civilised society, would collapse."

Which is BOLLOCKS, - letting justice take it's course - the bloke was given a SUSPENDED SENTENCE - where is the justice in that ? Clearly even jail isn't a sufficient deterrent, getting bashed with a cricket bat - now that might just work !

Frankly I think the burglar got what he deserved. Once again British Justice shows what a joke it is. I sincerely hope the 'Criminals' are released on appeal. Frankly it's time we were able to mate out suitable justice to scum like this burglar (and I don't care how much of a Mail reader that makes me sound like).

I might just form my own political party :-

"The Non PC Party" where the only item on the manifesto is that if your house gets broken into, you are permitted to smash the living crap out of the intruder without fear of being jailed.

Watch the number of burglaries drop like a stone, and Cricket bat sales go through the roof!
 




I think this is a difficult one.

The burglar had everything that was coming to him. You CANNOT break into someone's house and restrain the whole family. I'm outraged that he didn't get a significantly harsher punishment.

I have great sympathy for the guy that was sent down. He was obviously in a rage at what his family had just been put through. At the same time, it is obvious he used excessive force.

IMO, the burglar should have received a much harsher punishment, and the other guy should have been prosecuted but given a much more lenient punishment (fine and community service?). However the law is unfortunately far too black and white in these situations.

the Judge is an arse maybe if it had happened to his family things might look a lot different ,people who hold judgment over others should have some kind of experience of having the law broken when they are involved,Judges and magistrates should be level headed ...but should take into account what public feeling is going to be
50 previous does it for me the bloke should be serving a long sentence he obviously is the archetypal recidivist ...............the USA have this right 3 strikes and your out ..or rather your in for life

what would i have thought ? tough shit, dont break into people's houses and tie them up, hopefuly this will deter others from doing the same, is exactly what i would have thought.

Won't do it again will he.

If the guy had just used reasonable force to restrain the burglar he'd still not have been sent to prison.. So why not bash him round the head and hope you get let off..

Yes it is, the guy has done a damn good job of protecting his house from future burglaries. If he'd merely run off his property he may well have been back. By chasing him down the road and beating the crapola out of the little shit, it's fair to say neither him, nor any other local hoodlum will be going anywhere near his place ... well, not once he gets out anyway.
