Parking ticket - advice/help gratefully received

My car got ticketed back in March, for being parked in a voucher bay outside my house in central Brighton at 10.25am without a voucher on it. Thing is, the "from" time on the ticket was 9.55am, and I'm allowed to park in voucher bays until 10.

I sent in an appeal, which was rejected. I still can't believe the ticket is valid if the car was legally parked at the start time - one of the people in the office that deals with appeals told me that it was "an open and shut case" and apologised for the fact that he couldn't change a colleague's decision - and I'm keen to go to a formal hearing, but only if they will actually listen to what I'm saying and consider the facts.

Anyone got any experience or inside knowledge of how these things work? All advice gratefully received.

If what you say is right, then you must appeal to the next level.

When you do your appeal mention what the member of staff said.

Appeal it and you will win - first level are just jobsworth cretins - you need to get to the independent barrister/lawyer stage and they will throw it out

I'd try bribery. It worked for me a few years back in Toronto to avoid speeding tickets.

Has the ticket got 2 dates on it? It MUST contain an offence date AND an issued date. If one is missing, the ticket is illegal and therefore not valid.

Thanks for the help, I'm going to go to the formal hearing if possible.

Problem I've got now is that it's a company car, and the Council has sent the ticket to the people who own it demanding payment. I've told them not to pay because I want a hearing, but it seems they have "a policy" that all fines are paid and then the drivers are billed, regardless of whether the ticket ihas been fairly issued or not.

So I might end up being sued by them instead, because I'm not bloody paying it, end of story.

My wife took her terminally ill mother to Hove seafront yesterday (as a treat on her 70th birthday) so she could push her along the prom in her wheelchair, She literally has days to live, my wife parked in a disabled bay, with the her mothers valid disabled badge on prominent display, when they came back, the buggers had given her a ticket, saying that the disabled badge was not properly displayed.

Unbelievable really. My wife has already sent an email, with a signed covering letter together with a scanned image of her mothers disabled bagde. We will not let the buggers win!

There's a WhizzGo car parked in our street - part of the Council's car-sharing scheme - which has a permit on the windscreen allowing it to park anywhere there's a space, basically.

Doesn't stop the wardens slapping a ticket on every time they come past, though. They'll probably get it towed before too long. Since it's effectively owned by the Council, I wonder if the mayor will have to go and pick it up from the car pound in person?

i think that one of the tabloids would pick that up....

Good idea, especially as it's in the news already. We'll see how they reply, if it's negative, we'll take them to the cleaners !

Indeed they should. How can they give a ticket for the badge being not properly displayed. That sureley means that they have seen the badge, but thought lets give them a ticket anyway. That's just vindictive.

this happened to my mother in law. she had put her badge on display but the wrong way round. i believe that it should be displayed with the owners picture showing up. jobs worth :rolleyes:

she was let off btw edit: she is not a firework ;)

I always carry a camera in the vehicle with me for just this sort of nonsense. A few pictures which include the time and date usually make them think again. Any break in the yellow lines or a badly positioned sign makes the offence null and void too.

I'ma bit confused - if there are grounds for appeal then you definitely should do it... but are you saying you that were parked illegally? You're allowed to park there until 10 and were still there at 10.25, so the fact that you were spotted there just before 10 as well seems irrelevant.

I sympathise though - it's crap not being able to park outside your own house.
