They didn't change the rules. The Tevez/Mascherano deals were against the rules and still are. Liverpool changed Mascherano's contract and paid off the third party to make it legal. West Ham lied about the Tevez contract and got caught out when he was sold to Manure.Increasingly, as suspected, it looks like the 3rd party ownership issue is something that is getting in the way.

That could also mean that JC hasn't agreed to our terms, maybe the offer is too reliant on promotion clauses and he would rather have a higher wage from the start, he's not exactly falling over himself to play either for Brighton or in the Championship, so it will probably take a pretty spectacular deal to get this over the line.
From his point of view, there is interest from far bigger clubs than Brighton, OK no offers.... Yet, but who knows what may be on offer in 6 months if he waits.
The problem for him is that Boca seem to want to cash in now, $10million USD from Brighton is far better than a loan fee from Atl Mineiro. So Boca can't force him to sign for Brighton, but they can stop him going on loan.
