I'm currently looking for my next role and have found one which fits perfectly and which I'm well qualified to do.

It's working for a set of Christian run care homes as Head of IT. Then I get to this statement in the job ad :

  • Applicants must be evangelical Christians (This role has an Occupational Requirement to be filled by a Christian under the provisions of the Equality Act (2010)).
I'm not a evangelelical Christian. I'm not applying to be some preacher - just someone that can run the IT systems.

How is this actually legal to descriminate against someone of no religion ? Despite their quote of the Equality Act I can't see how this is actually allowed.

I know in faith schools they are allowed to reserve certain roles (head, head of RE, chaplain) for those of that faith so exceptions from the Equality Act do exist.

Not sure why it can be applied to an IT role though. Or why the institution would want to limit their applicants.

Google “Occupational Requirement” and you’ll see why it’s legal.

Yes, it’s almost certainly legal. It’s the ‘Occupational Requirement’ bit - note the capital letters, meaning it’s a defined term in the Act.

The same legislation would cover the legality of requiring nuns in a convent to not be male.

it's legal...whether it is moral for an IT person is another debate. I can understand why they'd want all staff to have a particular belief though.

It may be legal, but it’s daft. A very narrow view.
its obvious that if you are recruiting a chaplain, or a headteacher for a faith school, you might require a Christian, but why for an IT role.

Asking which font it required could lead to confusion.
