morning all, i have just received notice of an impending redundancy :nono:

there are a couple of questions i would like to put to you guys and girls as you all say things as they are (god forbid)

if i am not made redundant but i am offered a 'different' contract and i decide it is not to my liking, am i still entitled to a redundancy payment?

if i am made redundant what pay-off will i be entitled to (i have been at this place for 8 years and 1 month)?

i look forward to your sensible/not so sensible responses

I think if they adversly force you to accept a new inferior contract, and you decide to leave, then a tribunal could well view this as 'constructive dismissal' in which case you'll get compensation probably equivalent to the redundancy package.

Normally, you'd get 8 weeks money ( tax free if < 30K payment ), but this weekly rate can be capped to a statuatory maximum if the company is particularly mean.

However, on top of this, you'll get full pay for the notice period of your contract, which will be taxed.

If your company is tight they will limit you to the statutory minimum which is about £280 per week. You get a week and a half per years service over a certain age (i think it's 45).

depends how old you are?

Age 22-40 you get 1 weeks wages for each year in the job.

41-64 you get one & a half weeks wages for each year in the job

One more thing, if you have any redundancy cover on a mortgage, or payment protection on a loan or credit card, check the small print, and be aware that accepting voluntary ( rather than compulsory ) redundancy would probably void your policy.

you should be ok. Firm should give you a reasonable period (3 months?) to try out the new job without it affecting your redundancy rights. If you decide you like it make sure the transfer takes with it the rights of continuous employment, otherwise you could lose 8 years service. If it doesn't you may be able to claim redundancy and take the new role.

Check with your union, CAB or Staff Committee.

I think the 1.5 weeks pay is only for each year you work after becoming 45.
