Help neede legal advice

Hi,

I have just had a letter from a solicitor and i need some help!!. I downloaded an album last year, the download failed as far as i can remeber and never used it. Now i have a letter from a solicitor saying i can settle for the sum of £375!. Im not sure what to and am worried any advice will be helpful.

First thing to do is write back (using recorded delivery) asking them what this is about. Sounds to me like they're on a fishing trip. Make them aware that they must provide proof and an explanation. Do it ASAP.

Why do they want £375? Was it an illegal download?

I downloaded it through a torrent website but as i said i never finished downloading it!

It says they have proof they have my ip address and my name etc. The contacted the torrent provider and they said i was a member (im not though) I have 21 days to reply or they will take me to court!. I tried to call but they said no one was there and to call back monday.

They won't take you to court, it's a scam. They are just hoping that a small percentage of those they contact will pay up.

I wouldn't bother even replying, but if you do deny everything( as they will use anything they can against you ) and ask for evidence that the money is owed.

This sounds like a scam, check if the are a genuine solicitor. If they are write back and ask them for proof, if they're not report them to the Police. £375 is ridiculous and they have no right to ask for it.

If it does go to court (I really doubt it will) say you provided an open wireless access point for your community or something. It will not be against the terms of your internet provider and until the DEA is in place (hopefully never) will stand up in court.

Should add that this is my day job, I know what I am talking about.

acs law tried this on me last year and wanted £650 for something I did not do.This might help.

Well they need proof don't they ? Without it they have no case. The open Wireless connection is a good reason too as anybody can use your access.
