I guess mutual consent could consist of Gus offering his resignation with us accepting it? which is different from a straight resignation.

The financial settlement could just be paying him his wages for May and holiday pay, so a £100k is probably what he is entitled to.

If he wants to fight it and claim unfair dismissal, it would be unwise as the risk is that he has to pay all of his and our legal costs if he fails, potentially costing him at the very least tens of thousands.
