Well then, the commission (which commission??)

The Electoral Commission.

The Representation of the People Act 2002 inserted a section 66A into the initial 1983 of the same name and this read as follows. It is a criminal offence ‘to publish, before a poll is closed, any statement about the way in which voters have voted in that election, where this statement is, or might reasonably be taken to be, based on information given by voters after they voted.’
That's saying you can't say how other voters have voted, it doesn't say you can't say how you voted.

Otherwise how do you think exit polls are taken? They ask people how they voted when they exit the polling station. You're suggesting they wouldn't be allowed to answer.

Try again Trig.

"It is an offence....to publish [ie be NSC], before a poll is closed, any statement about the way in which voters [Hillian] have voted in that election, where this statement is..... based on information given by voters [Hillian] after they have voted".

The law is clear - NSC cannot publish how Hillian has voted until after 10pm tonight. The electoral commission is, I suggest, not referring to publishing. If Hillian wants to tell people down a pub how he voted, that's up to him. NSC, as a publisher, can't publish how he voted until after 10pm tonight.

"Otherwise how do you think exit polls are taken? They ask people how they voted when they exit the polling station. You're suggesting they wouldn't be allowed to answer."

Seriously?! Of course the poll can be taken. It just can't be published until after 10pm. S'all.

If you're going to be pedantic, one of the rules is that you're correct...

Try again Trig.

It's not illegal to post how you voted.

http://www.telegraph.co.uk/news/gen...589297/Is-it-illegal-to-tweet-how-I-vote.html

SNP leader Nicola Sturgeon also told her 193,000 followers who she voted for in Glasgow East in a tweet endorsed more than 1,000 times.

Yes, it's illegal for you or I to say how he voted, but it's not illegal for him to say how he voted.

They were referring to publishing your information on social media.

A statement by the Electoral Commission said: “A voter may volunteer information about who they voted for, provided no undue influence is exerted on them to do so.

“There is no explicit provision in law that prevents people from tweeting or re-tweeting that information. There is, however, provision to prevent exit polls to be published until polls have closed.”

BREAKING NEWS: Holland announce they intend to table a motion in their Parliament to have a referendum to leave the EU if Brexit wins. They intend to do this the very next day. The president of Holland has also stated that Denmark, France and Sweden are looking to follow ... interesting timing. The whole rotten edifice is coming apart, so where is the security in the EU now? Please let everyone know ... we may now finally get a Common Market instead of USE if we leave. There are now countries waiting for us to leave ....Be strong, be European and leave the EU.

Phew :)

If you're going to quote an article - at least read it. All of it. From the Torygraph piece:

"However Gavin Millar QC from London’s Matrix Chambers said: "Twitter is a publisher, so it’s publication by whoever does it.
“I think it’s probably not contrary to Section 66A.

“Section 66A has to be read as a prohibition on publishing an exit poll, so whatever the aggregation of information on Twitter being put out by an MP it would have to amount to an exit poll.
“It’s a question of when that line is crossed."

Twitter absolutely has been treated as a publisher. So could NSC be.

Anyway...we're not going to agree on this. Do read the article in full though, eh?

I'm out.

I don't see how it's relevant that it's a Tory paper. I've searched online and everything I've seen suggests it's legal.

But as the QC you quoted said, it would be publication by whoever does it, which would mean that if I say who I voted for, I am publishing who I voted for, and not who anyone else has voted for.

It's clearly absolutely fine, people (including party leaders) do it on facebook and twitter every election, and the Electoral Commission says it's fine.

I'm reading that as you stating you are unwilling to rethink your position and realise you're mistaken.

I did, the QC agrees with me. Did you misread what he said?

Good, glad to see you've changed your mind after all :)

Yeah, funny one that but so brazenly political. he is a modern-day Heseltine that Johnson.

His brother Jo is the Universities Minister, campaigning for REMAIN, his sister Rebecca is a columnist in the Mail on Sunday [and probably has another job :)] she was on the anti-Farage boats on the Thames, a strong REMAINer. I know his Dad, Stanley, a passionate environmentalist and strong IN vote.
Oh yes... those anti boats on the Thames drowning out those poor north Sea fishermen who have seen their industry and communities shattered by EU quota ambushes...... very democratic, very sympathetic.... support the working man..?.. my arse... Remain stands for Corporate status quo.. and all the profit and tax breaks that brings.

They were objecting to the fraud Farage, who by his own boasting admission, managed one fisheries meeting, out of forty, where he could have done something for the fishermen. As you know.

Bugger this for a game of soliders - can't be arsed to go out in this weather.

I intended to vote Remain, so if I ask very nicely is there a leave voter prepared to promise not to go out and vote either so we cancel each other out? :moo:

The majority of immigration is from outside of the EU. Plus of the population only 0.5% is immigration of which 98% pay taxes. Immigrants take LESS of out the system than they put in.

Turkey have been in talks to join the EU for years and years and out of 35 hoops they have to jump to get in they have successfully jumped one..ONE. and even if by some miracle they jump all 35 we can VETO them joining by being PART of the EU. Turkey are NOT joining.

----------------------

All you have to do is look at the list of people who back leave and who backs remain. Seeing a line up of hate mongering bile like Trump, Katie Hopkins, The BNP, Boris Johnson.. surely it's a no brainer. How about believe in the experts who vote remain like the head of the bank of england and the 100s of other professionals.

I cannot believe the shit brexiters spout, no facts, just sound bites 'take control of our boarders' to entice the simple in... Jesus this country has a lot more simpletons than i thought.

remain will win 55%-60% will be even higher by ratio of voters too
wash your mouth out son:whistle:

You misread my motive. I'm out because I get very tired of reading threads which descend into bickering between two people, and I have no desire to be a guilty(-ier) party. I'm more than happy to continue the debate privately if you're so inclined though.
