Cheers, that's what I was getting at. The waiver might have some standing though, as what you've quoted only says negligence isn't excused. Just like their have always been waivers at motor-racing events etc.Section 2(1) of the Unfair Contract Terms Act 1977 states 'A person cannot by reference to any contract term or to a notice given to persons generally or to particular persons exclude or restrict his liability for death or personal injury resulting from negligence'. So, any waiver that says 'we accept no liability for death or personal injury as a result of you eating this burger ' is null and void.
