I can't see how this protocol doesn't qualify as a constitutional change. And I have never understood why it's a breach of a treaty to invoke one of its clauses. If clause 16 says that this protocol can be suspended in certain circumstances, and those circumstances arise so the treaty is suspended, how is that a breach of the law?

I think it depends on what the 'certain circumstances' are and the extent to which they could/should have been envisaged before signing. Taken to the extreme, an agreement could be made and then just altered for any purpose that suits the party that chooses to break it. In other words the 'agreement' become meaningless... especially as in this case everyone knew that it couldn't be sustained and one side (Johnson's) was acting in bad faith........

There hasn’t been any constitutional change to Northern Ireland. The Single Market and Customs Union are purely trading agreements.
Changing that will cause a constutional change.
The Good Friday Agreement was only possible because the UK andIreland were in the EU.
Northern Ireland voted overwhelmingly to remain.

That is one of the most confusing posts I have ever read on NSC. You clain that the Brexit arrangements don't breach the good Friday agreement (GFA) because they immediately breached them, and consequently this no longer matters. Er, yes, mate

Brexit created an unsolvable problem for the GFA to remain in place. Project Fear in that regard = Project Reality. Whether the Irish Back Stop, Protocol, Green Lane Red Lane - there is no real way of solving this other than a fudge. So Johnson and his cronies just went, **** it, may as well make it a huge great fudge.

As a voter for Brexit, what did you imagine was going to happen with NI directly adjoining the EU via an open border secured by the GFA? I'm curious what people actually thought would happen. In 2016 it seemed obvious what has happened would happen.

Ah, good point. I used to know a contributor on another forum, who used to sprinkle spelling mistakes in his comments, to mask his genuine illiteracy, which I had already helpfully pointed out. All good clean fun.

Sorry, I was referring to others. I probably should have been clearer. I do tend to use shorthand after a glass of wine for medicinal purposes.
