The club can ban anyone from their premises for any reason at any time. They don't need any kind of legal ruling to be able to do that.If the club can identify him, can they ban him for tomorrow's game, or do they have to wait for any legal action to play out?

No you're wrong. No such privacy laws exist in the UK for pictures taken by private individuals of other persons. Do the same in Germany and yes, you could be in strife for posting a persons picture on social media without their permission. France has similar privacy laws. Exceptions might be where you have taken a picture of a crowd scene or a historic building where you could obviously catch other members of the public.Wrong.

I agree entirely with the expressed sentiment, and feel sorry for the poor fan subjected to such awful primitive behaviour by others alleging to be Albion fans....... but playing devils advocate, Unfortunately it may be hard for the club to prosecute even if they did find the accused bloke, unless he admits it was him.Whilst I’ve no doubt the incident took place and that a life ban should only be part of the punishment, the club is going to find it difficult to take action unless they find the scum perpetrator, the victim(s) and witnesses.
Hopefully NSC can do its stuff in helping the club and fellow supporters.

At least the near-universal sense of disgust I’m seeing here should be some consolation. I don’t like these generalisations made based on small samples. I’ve lived all over the place and without doubt Brighton fans are among the most benign. Which is why this sort of incident provokes such outrage. I recall at West Brom in our 1st Prem season some bloke in front us punched another Albion fan for singing a song he didn't like. He had his henchmen around him eyeballing everyone so no one had a realistic chance of intervening.

If he denies it, or claims mistaken identity, without CCTV that may be harder.
I hope the club contact Marseille and ask for CCTV footage (before it may be deleted or overwritten).
At the very least you'd hope this individual is prevented from travelling abroad to watch Albion.
