Albion Archives - use of footage (FAO 1066)



After following the link in your sig, I found a very familiar video clip of George Parris. Whilst I am fully aware that I am not the copyright holder, I have contacted the club about issues of copyright over old TV footage and understand the situation. As you haven't had the manners to ask me if I mind, I can only assume that you haven't contacted the club and have just posted it on an open platform without due regard for copyright issues.

If you want to steal footage from a pay site and pass it off as your work, that is your business. But please do not use my footage for use other than personal. I understand the copyright situation and am happy for all of my video clips to be hosted in a central location where I have the ability to remove it if necessary. But I am not willing for it to be put anywhere else - especially when you link to where it come from.

I have posted this publicly so people understand the terms of Albion Archives video clips. I offer these old clips as a service - at cost to myself. I have ample bandwidth to cope with any amount of demand without having videos mirrored. I just want them all under my control so they can be removed if neccesary due to copyright.

I will add a disclaimer to the site when I get chance - I didn't think it necessary before.

TGC, I am fully aware of things like this and I ALWAYS put where I get my content from and never accept it as my own.

The only ones I think of is like George Paris, Leon Knight vs MK Dons which haven't been edited at all, but I feel that some content should be allowed to be viewed by some people.

If the club want me to remove certain content, I will do so ASAP but I am not trying to make a profit or anything - if I wanted to I would make it do so on Google Video as there is a feature for that.

The club should email me at Adrievdm@gmail.com if they wish they want any content removed.

That was my point - it is nothing to do with the club. I don't want footage credited to me taken out of my control.

To be honest, Albion Archives is just like Google Video, Anyone in the world can view them freely and easily, if they knew the name or URL etc.

That George Paris clip was pure entertainment I believe and Albion Archives has a far less audience than Google. Because Google Video is like AA, but with a bigger audience I thought I would share the clip with the larger audience who probably never hard of AA before.

I do know you are not the creator of your clips, but I was merely stating that I found it from your site to credit you, I wasn't trying to get you in any sort of sticky situation.

I hope I am not going of topic, was gonna say one more thing but I forgot.

No it isn't.

As I know from the brief period when I was (very marginally) involved in fanzine production, the owners of archive copyright material don't generally have a problem with stuff being reproduced for small-scale circulation.

But if it's intended to reach a wide audience, they reserve the right to get a bit twitchy.

My guess is that TGC is working on the same principle. His site has a limited audience and the holders of any "rights" in the material (presumably the Football League) are unlikely to come chasing him. If they do, he can easily remove what needs to be removed.

But posting the material on the mighty Google, with its potential worldwide audience, is a whole different kettle of fish. And identifying TGC as the source is something he (rightly) isn't happy about.

The Football League have a track record in pursuing people who they breach their rights big-time. 1066 should be careful - and he should certainly respect TGC's wishes.

I can remove content I host on Google at anytime I like, and any day of the year. I have the right to change content on it, as long as it meets their Terms. Like I said, I am only a fan wanting to share what a great club we can be with the players we produce etc etc.

I have seen a lot worse on Google Video, with plenty of Premiership goals unedited - I think they take priority first, it always does with the FA.

As I have said, I have checked with the club and they have an agreement with the TV companies to use their footage. They are not able to grant me copyright but have no objections - particularly given the money I have raised using this footage.

However, were Meridian or Sky to take exception and send me a Cease and Desist, I need control over my footage. I do not have this when you have recklessly moved it onto a global site. I cannot easily remove this.

Besides which, your other two clips are "stolen" from a site which still requires payment to access this footage. If I were to rip and post everything Seagulls World did, how many subscribers would leave or go to the commentary only option? How much money would this cost the club? I have always made a point of not selling or offering anything that would cost the club revenue. The only current goal clips I use are from standard TV coverage which is available to a large proportion of the UK public. I have 40 odd DVD's of converted official club videos which I don't sell in case the club wants to re-release them.

Besides which, it would only have been good manners to ask me before using my footage, especially if you are going to link to the source.

It doesn't meet their terms, numbnuts. It is copyright material - a concept you seem blatantly unaware of. If you continue to use my material, I will be forced to take the site down. I wouldn't let anyone else post it without permission, let alone anyone as reckless as you.

If you own the necessary rights (including copyrights, trademarks, rights of publicity, and any other relevant rights for your content), you can submit your video to us by signing up for the Google Video Upload program.
